These Terms of Use govern the use of the TimeSwitcher platform. By registering or using the platform, the user accepts these terms.
These Terms of Use apply to all users of the TimeSwitcher platform (hereinafter "Platform"), provided by the operator. The Platform enables the exchange of services based on time credits (1 hour = 1 credit).
By registering or using the Platform, the user enters into a user agreement with the operator. These terms apply exclusively.
"Platform" refers to the web and mobile application TimeSwitcher. "User" refers to any natural person who has registered an account. "Provider" refers to a user who offers a service. "Recipient" refers to a user who receives a service.
"Time credits" refers to the internal accounting system in which 1 hour equals 1 credit. "Booking" refers to the agreement for the provision of a service.
Registration is only permitted for natural persons aged 18 and over. The user confirms upon registration that their details are truthful and correct.
An account is non-transferable. The user is responsible for all activities carried out under their account. The operator reserves the right to block or delete accounts in the event of a breach of these terms.
Identity verification is required to use the core features of the Platform. The user uploads a valid official identity document (passport, national ID or driver license).
The Platform uses an automated check that, among other things, verifies the expiry date of the document. Documents that have expired are not accepted.
Identity verification serves solely to build trust within the community. The verification status ("Identity verified") is visible to other users, but the underlying ID data is not.
The operator does not guarantee the accuracy, completeness or authenticity of the information contained in the identity document. The automated check of the expiry date does not constitute a check of the document's content correctness.
The operator is not liable for whether an uploaded document is a correct, genuine or valid identity card. The check is carried out in good faith but cannot rule out forgeries, manipulation or false information.
The user indemnifies the operator against all claims by third parties arising from the use of an incorrect or forged identity document. The operator is excluded from any liability for the information contained in the ID.
Time credits are a purely internal accounting system of the Platform and do not represent a monetary payment, currency, investment or trading instrument. Time credits have no monetary value and cannot be exchanged for money.
Upon registration, the user receives a starting balance of 3 time credits. For each hour provided, the provider is credited 1 credit; for each hour received, the recipient is debited 1 credit.
The operator reserves the right to cancel time credits acquired through misuse.
Users can offer and book services in over 10 categories. A booking is completed when the provider accepts a request or a direct booking via available time slots is confirmed.
Processing takes place via the Platform. Communication between the parties takes place via the in-app chat. Sharing contact details (phone number, email address) before a booking is completed is prevented by the system.
The operator only provides the technical mediation infrastructure and is not a party to the contract concluded between provider and recipient.
Costs incurred in connection with the provision of a service (e.g. paint, food, fuel, consumables) are to be borne by the recipient or made available before the start.
These costs are not part of the time credits settled via the Platform. The time credits cover only the working time.
The provider must inform the recipient of any expected additional costs before the start. Costs not communicated in advance do not have to be borne.
Providers undertake to keep agreed appointments on time and to provide services with the requisite care and expertise. Where special qualifications (driver license, insurance) are required, the provider must present them.
Recipients undertake to provide the agreed number of time credits and to inform the provider in good time in the event of cancellation. Both parties undertake not to use the Platform for illegal, fraudulent or abusive purposes.
If a provider or recipient does not show up for the agreed appointment, this can be reported as a no-show. The report must be made within 24 hours of the agreed appointment.
In the event of a confirmed no-show, the time credits are refunded. The provider has the right to contest within a deadline. Cases that cannot be resolved are escalated to the admin.
The operator reserves the right to block accounts in the event of repeated no-shows.
After a service is completed, both parties can rate each other. Reviews should be truthful and objective.
The operator reserves the right to remove insulting, false or abusive reviews.
Users can create and manage private groups. Groups enable the closed exchange of services between members.
The group creator is responsible for member management. The operator assumes no liability for content or processes within groups.
The first service a user offers is free. Each additional service costs a one-time fee of €5. There is no limit on the number.
Payment is made via the integrated payment interface. The operator reserves the right to adjust the pricing model.
The operator is only liable without limitation in cases of intent and gross negligence. For slight negligence, the operator is only liable in the event of a breach of essential contractual obligations and only to the amount of the typically foreseeable damage.
The operator is not liable for the quality, legality, safety or completeness of the services mediated via the Platform. The contractual relationship exists exclusively between provider and recipient.
The operator does not guarantee uninterrupted availability or freedom from errors of the Platform.
The operator reserves the right to adjust these Terms of Use at any time. Material changes will be communicated to users. Continued use after notification constitutes acceptance of the change.
The user can delete their account at any time. A claim to transfer remaining time credits exists only within the defined beneficiary rule.
The operator reserves the right to temporarily or permanently block accounts in the event of breaches of these terms or applicable law.
Swiss law applies, unless mandatory consumer protection provisions provide otherwise. The exclusive place of jurisdiction is the operator's registered office, insofar as permitted by law.
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
